CONTEST RULES

Jack Ryan: Shadow Recruit Motorcycle Contest Rogers Sportsnet Inc.

  1. Contest Period & Contest Sponsor. This contest (the "Contest") is brought to you by Rogers Sportsnet Inc. ("Rogers"). The contest period (the "Contest Period") starts at 12:00am on December 23, 2013 and continues until 11:59pm on January 17, 2014. All times are Eastern.
  2. How to Enter. No purchase necessary. To enter, go to www.sportsnet.ca/jackryan (the "Website") and complete the entry ballot in full and submit as instructed by the Contest Closing Date.

    LIMIT: Only one (1) entry per person. Any attempt or suspected attempt to enter more than once per person, and any use of robotic, automatic, programmed, illicit means, or any other entry methods not authorized by these Contest rules shall be deemed as tampering and will void all of your entries. Entries that are late, lost, stolen, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions these rules will be judged void. All entries become the property of Rogers upon receipt and none will be returned. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).

  3. Eligibility. This Contest is open to residents of Canada, excluding residents of Quebec, who are over the age of majority in their province or territory of residence, excluding employees, officers and directors of Rogers, its affiliates and representatives, Contest suppliers and judges, and those with whom each of the foregoing individuals are domiciled.
  4. Prize. Entrants are eligible to win one (1) Grand Prize consisting of one (1) Ducati Diavel motorcycle. Grand Prize is valued at approximately $25,238.55 CDN (plus shipping costs up to $1,000 CDN).

    The following conditions apply: Rogers to pay a maximum of $1,000 CDN in shipping fees to ship Grand Prize to winner's Canadian residence; however, additional shipping costs, if any, to be paid by winner in order to claim prize. No financial compensation will be made or required if actual Grand Prize value (including shipping costs) is lower or higher than the total value quoted in these rules. It is the sole responsibility of the winner to obtain all necessary licences, permits, and insurance in order to operate the Grand Prize; winner shall indemnify and save harmless Rogers for any claims relating to the ownership or operation of the Grand Prize.

  5. Draw. A random draw from all eligible entries received will be made by a Rogers representative during the week of January 27, 2014. The selected entrant will be contacted by telephone or by email. A selected entrant will be disqualified and required to forfeit any claim on the Contest prize if:
    • he or she cannot be reached within one (1) business day following the first attempt of contact; or
    • the terms set forth in these Contest rules are not adhered to, including without limitation those requirements set forth in the Winner Confirmation section below.
  6. Odds of winning. Odds of winning depend on the number of eligible entries received. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Rogers in its sole discretion. Rogers takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Rogers is not responsible for any errors or omissions in printing or advertising this Contest. All Contest entries become the property of Rogers and will not be returned.
  7. Acceptance of Grand Prize. Grand Prize must be accepted as awarded and is not transferable, redeemable, refundable or exchangeable for cash, and not replaceable if lost or stolen. Rogers reserves the right, in its sole and absolute discretion, to substitute a prize of equal or greater value in the event of the unavailability, for whatever the reason, of the advertised prize.
  8. Winner Confirmation. To be declared a winner, selected entrant must:
    • correctly answer without assistance of any kind, whether mechanical or otherwise, a time-limited, mathematical skill-testing question to be administered by telephone during a pre-arranged, mutually convenient time;
    • be in full compliance with these Contest rules; and
    • sign and return a Release of Liability and Publicity Release form (the "Release Form") and any other documentation as required by Rogers in its sole discretion.
  9. Disqualified Selected Entrant. If a selected entrant does not fulfill the conditions set out in these rules, or declines or forfeits the Grand Prize, Rogers reserves the right, in its sole discretion, to cancel the Grand Prize or select another entrant.
  10. Decisions. Decisions and rulings are final and binding without appeal in all matters related to this Contest and the awarding of the Grand Prize.
  11. Release of liability / Consent to Publicity. By accepting the Grand Prize, the winner:
    • confirms compliance with the Contest rules;
    • acknowledges that the prize is not transferable (except as provided for herein and only at Rogers' sole and absolute discretion) and must be accepted as awarded or otherwise except where stated;
    • consents to the use of his/her name, city of residence, entry, voice, statements, photographs and/or other likenesses for publicity, advertising or informational purposes in any medium or format carried out by Rogers and/or advertising agencies regarding the Contest or the Grand Prize, without further notice or compensation; and
    • releases each of Rogers, Paramount Pictures Corporation, and Paramount Pictures Entertainment Canada, Inc., each of their affiliates, advertising and promotional agencies, suppliers of materials or services related to the Contest, and all of their respective shareholders, directors, officers, employees and agents (collectively the "Releasees") from and against all liability in connection with the Contest and/or the awarding and/or use of the Grand Prize, including, as set out below in the LIMITATION OF LIABILITY section.
  12. LIMITATION OF LIABILITY. The Releasees do not assume any responsibility and the entrant releases the Releasees from any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of or in connection with (i) participation or attempted participation in the Contest and (ii) the Grand Prize, including, without limitation the administration of the Contest, the selection and confirmation of the winner, and the arranging, awarding and use of the Grand Prize. Without limiting the generality of the foregoing, the Releasees are not responsible for: the incorrect or inaccurate capture of entry information; late, lost, stolen, illegible, damaged, misdirected, mutilated, garbled or incomplete entries or entries that are altered or otherwise irregular, contain false information, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of the Contest rules; any loss, damage, or claims caused by the awarded Grand Prize or the Contest itself; any failure of or problem with the Website, or any Website feature howsoever caused, including, without limitation, any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, technical malfunctions of any computer online systems, servers, access providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including, without limitation, any injury or damage to an entrant's or any other person's computer related to or resulting from participating in or downloading any material connected to the Contest, all of which may affect a person's ability to participate in the Contest; any website functionality lost due to not having cookies enabled; any errors, omissions, incorrect or inaccurate information in any Contest-related materials, including, without limitation, printing or advertising errors or the failure of or problems with any equipment or programming associated with or used in the Contest howsoever caused; the security or privacy of information transmitted via computer networks or breaches of privacy due to interference by third party computer "hackers" or otherwise; and any claims regarding the accepting, arranging, awarding or use of the Grand Prize. Entry material/data that has been tampered with or altered is void.
  13. Privacy. Rogers is collecting personal data about entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by the entrant unless the entrant provides or has provided Rogers with explicit permission to do so. Please see the Rogers Privacy Policy at http://www.rogerspublishing.ca/privacy.htm for information on each company's policy towards maintaining the privacy and security of user information.
  14. General. This Contest will be run in accordance with these Contest rules, which shall be subject to amendment by Rogers without notice or liability to you. Entrants must comply with these Contest rules and will be deemed to have received and understood these rules by participating in this Contest. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein. This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. Except as expressly warranted herein, the Grand Prize is provided "as is" without further warranty of any kind. Rogers reserves the right to cancel, modify, or suspend this Contest or to amend the Contest rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, bug, corruption, security breach, or other cause beyond Rogers' reasonable control, Rogers reserves the right to cancel or suspend the Contest and/or conduct a random draw from all previously received eligible entries.
  15. Unsportsmanlike Conduct. Rogers reserves the right, in its sole and absolute discretion, to disqualify without notice any entrant that they find to be: violating the Contest rules; tampering or attempting to tamper with the entry process or the operation of the Contest or the Website; acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; or attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Rogers' representatives. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, ROGERS RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION, AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE CONTESTS.
  16. Dispute regarding identity of entrant: If a dispute arises regarding who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the email address provided at the time of entry, provided the name of the authorized account holder corresponds with the full name on the entry form. The individual assigned to the email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address is considered the authorized account holder. A selected entrant may be required to provide proof that he or she is the authorized account holder of the email address associated with the selected entry. All entries must be submitted from a valid email account. If the name of the authorized account holder does not accord with the full name on the entry form, the entry may be disqualified at Rogers' sole and absolute discretion.
